Dispute resolution

Dispute resolution is one of Weerawong C&P’s four core practice groups. Weerawong C&P provides comprehensive litigation, arbitration and dispute resolution capabilities. The Firm recently represented PTT Plc in successfully defending a high-profile claim filed by civic groups in the Thai courts, challenging the corporatization of PTT’s predecessor, the Petroleum Authority of Thailand. Our lawyers are also experienced in arbitration and in alternate forms of dispute resolution. We assist clients in the negotiation and preparation of arbitration clauses in contracts, the evaluation of comparative costs of different kinds of arbitration, the selection of arbitrators, representation in Thai and international arbitration proceedings and representation in connection with enforcement or annulment proceedings following an award.

Our recent track record includes the following high profile transactions:

  • A State Entity of the Thai Government’s arbitration proceedings brought against them by a German Investor alleging breach of bilateral investment treaty between Thailand and Germany.
  • PTT’s successful defense in the Supreme Administrative Court in a petition by Foundation for Consumer to invalidate the corporatization of the Petroleum Authority of Thailand
  • Five Largest Thai Banks’ successful defense (as guarantors) against claims filed by the Pollution Control Department of Ministry of Natural Resources and Environment on the Klong Dan Wastewater Treatment Project.
  • Sol Melia, a global resort hotel chain, in a successful claim against a Thai hotel operator before the Central Intellectual Property and International Trade Court.
  • A Bangkok-based and Most Reputable Hospital’s successful tort claim against another best known hospital in Thailand on the misleading advertisements placed by the latter.
  • A reputable Italian Bank’s successful defense of lawsuit filed by a local leading commercial bank in Thailand with the Intellectual Property and International Trade Court of Thailand
  • A Publicly Listed TV Channel’s arbitration in relation to the dispute on the concession fees
  • Certain Leading Mobile Phone Operators’ arbitration proceedings involving the disputes on concession agreement and revenue-sharing agreements made with the state agencies
  • An Independent Power Purchaser’s arbitration proceedings with EGAT (as a power purchaser)
