Poonpat Vasupongpipat is a senior associate at
Weerawong C&P. He has a wide range of experience in arbitration and litigation, particularly in
relation to administrative, business reorganization, corporate and commercial matters. Poonpat
assists clients with case strategy, negotiations and preparations for legal proceedings. Recent Experience Representation of a
well-known construction company in Thailand in arbitration proceedings since 2018
in connection with disputes with the owner of a cogeneration power plant project re: claims for
outstanding payments, scope of work, and failure to perform other duties under the turnkey
agreement. Representation of Pace Development Public Company
Limited, and its affiliates in Thailand, as well as Siam Commercial Bank Public
Company Limited in relation to the rehabilitation of Pace Development in Thailand and the
reorganization of its assets and businesses, namely, Dean & DeLuca Group (in the United States
under Chapter 11 of the US Bankruptcy Code) with the total amount of claims involved in the
rehabilitation exceeding THB 30 billion. 2020 Representation of a well-known
real estate developer and its subsidiary company in the environmental impact
assessment (EIA) process. 2020 Representation of RRB Group Private
Co., Ltd., the owner of international luxury brand hotels and resorts in a labour dispute
re: grounds for dismissal filed by one of its high-level employees in the Central Labour Court of
Thailand. 2019 Representation of a carbon
black company in filing an appeal before the Supreme Court in relation to a lawsuit filed by
individuals claiming damages for the environmental impact of carbon manufacturing operations.
Weerawong C&P also advised a rayon company, the leading manufacturer of viscose staple fiber in
Thailand, on a related environmental law claim in relation to a class action filed by residents.
2019 Representation of a telecommunications
company in arbitration proceedings in relation to public-private partnership agreements for
the construction, installation and maintenance of submarine, underground and overhead cables. (2017
- 2020) Representation of companies in arbitration claims and defense
of disputes arising from concession agreements with the Government of Thailand. These
disputes include claims for revenue share payments from the government authority, and defense of
claims re failure to perform duties under the agreements. Representation of
a plan administrator and defense of claims under business reorganization law in
litigation against the owner of a debtor company. The matter involves the revocation of the plan
administrator in relation to accusations that the reorganization plan was breached. Representation of a construction company working on a mega-project
of the Bangkok Metropolitan Administration in litigation against a listed company in Thailand over
claims for outstanding payments. Representing and defending a real
estate developer and its subsidiary company in litigation against a number of parties.
Cases include administrative law disputes, failure to comply with an environmental impact assessment
report, and civil disputes relating to consumer claims. Representing and
defending telecommunication companies in Thailand in arbitration claims and
litigation against a government authority. The cases relate to a concession agreement and claims
from the government authority for revenue share payments, and disputes relating to the Notification
of the National Broadcasting and Telecommunications Commission. Representing
and defending a securities company in legal proceedings relating to a share
purchase agreement and a securities agency agreement. Representation of a
telecommunications company in arbitration proceedings in relation to public-private
partnership agreements for the construction, installation and maintenance of submarine, underground
and overhead cables. Representation of several clients as defendants in cases
filed by the Public Prosecutor and the Committee of the Anti-Money Laundering Office. The cases
involved the defense of civil and criminal charges and penalties including the seizure of assets,
fines and imprisonment. Representation of Saha Farms Company
Limited in an appeal of the official receiver’s orders under the business reorganization
process of the Bankruptcy Act. Representation of Asia Wealth
Securities Company Limited in the Civil Court. |
